The retrial of John Albert Cabell, charged with the 1981 slaying of Haynie's Corner ice cream store owner Otis "Carl" McCown, will be longer than the original oneweek estimate. Both sides had expected to conclude the trial this week but Vanderburgh County deputy prosecutor Robert Zoss said today the case will continue into next week.

It was moved out of Evansville because of pre-trial publicity. Special to The Press City garage A city garage worker has been fired following complaints by residents that the employee drank beer while on the job and urinated in a neighboorhood yard. City Personnel Director Tom Dorsey said the discharge of Leroy Graham was effective Monday.

Dorsey said it is possible that Graham, a member of Teamsters Local 215, could challenge the firing through the grievance Cabell, 35, was found guilty of voluntary manslaughter in June 1982 but his conviction was overturned by the Indiana Supreme Court, which said the judge improperly instructed the jury. At that time he had been sentenced to 20 years in prison. Today some of Cabell's relatives were to testify for the prosecution, saying he was out that night and that they later heard the defendant and James Fisher convicted of being an accomplice in the case, talk about the slaying. Yesterday witnesses testified how police questioned various people and eventually implicated Cabell as the gunman. The shooting occurred during a robbery outside McCown's ice cream store.

worker fired procedure set up in the union contract. Graham had been employed by the city for 11 years. The firing came after city officials investigated complaints by residents in the 2000 block of Waggoner Avenue about a worker on a crew repairing the street. The firing, the city's final disciplinary decision in the case, was based on the worker's improper conduct by drinking on the job, Dorsey said.
